DELIVERY TERMS & CONDITIONS

Supernova Containers works with independently owned and operated delivery partners to provide container delivery services. We collect the delivery fee on behalf of these partners to help facilitate a smooth and coordinated drop-off. While we assist with scheduling and communication, all delivery operations and final safety decisions are made solely by the delivery partner.

By purchasing a container and scheduling delivery through Supernova Containers, the client agrees to the following terms.


1. Payment Terms (Payment on Delivery)

All delivery fees and container balances must be paid in full before the container is unloaded at the client’s property.

Supernova collects the delivery fee as a convenience to ensure the delivery partner is compensated and scheduling can proceed without delays.


2. Independent Delivery Partners

Delivery services are performed by independent companies that are not employees, agents, or contractors of Supernova Containers.

Supernova:

  • Facilitates communication
  • Helps coordinate scheduling
  • Provides delivery instructions to the client and driver

The delivery partner:

  • Controls all aspects of the delivery
  • Maintains responsibility for equipment and safety
  • Has final authority to determine whether the site is safe and accessible

3. Client Responsibilities

To ensure a successful delivery, the client is responsible for:

Site Preparation

  • Providing firm, dry, stable ground
  • Ensuring adequate turning space, straight-line clearance, and overhead clearance
  • Removing obstacles such as vehicles, debris, low branches, snow, or ice

Access & Information

  • Providing accurate delivery details, measurements, and site notes
  • Ensuring access routes are suitable for a truck and tilt-deck trailer
  • Confirming final delivery details directly with the delivery partner

Presence at Delivery

  • Being on-site during the delivery window

or

  • Ensuring an authorized representative is present to approve placement

Weather & Condition Updates

  • Reporting any changes in weather, ground saturation, access, or safety concerns as soon as possible
  • Acknowledging that weather may affect delivery timing

4. Delivery Windows & Timing

The delivery partner will provide an ETA on the day of delivery. Please note:

  • Depot delays, traffic, road conditions, and weather may affect timing
  • Flexibility is required and appreciated
  • Exact delivery times cannot be guaranteed

5. Failed Delivery Terms

A delivery is considered failed when the delivery partner cannot safely access or unload the container due to conditions outside their control.

A delivery may be classified as failed if:

1. Unsafe or Improper Site Conditions

  • Soft, muddy, unstable, or saturated ground
  • Insufficient turning radius or straight-line clearance
  • Unsafe slopes or uneven terrain
  • Obstructions such as trees, fences, debris, or overhead wires

2. Client Not Present

  • No one is on-site to approve placement
  • Incorrect or missing access instructions (gates, codes, locks)

3. Incorrect or Incomplete Information Provided

  • Wrong address
  • Inaccurate measurements or access details
  • Undisclosed hazards or obstacles

4. Weather or Ground Conditions Affect Safety

  • Rain, snow, ice, wind, or saturation preventing safe access
  • Unreported changes in conditions

5. Driver Determines Delivery Is Unsafe

The delivery partner retains full discretion to postpone, refuse, or modify delivery if conditions pose risk to equipment, property, or personal safety.


6. Fees for Failed Delivery & Operational Exceptions

If a delivery cannot be completed for reasons outside the delivery partner’s control, the client may incur:

Delivery Partner Fees (Driver-Assessed):

  • Wait-time fees
  • Dry-run fees
  • Redelivery fees
  • Additional mileage or towing/recovery fees

These fees are set by the independent delivery partner and must be paid prior to rescheduling.

Supernova-Assessed Fees (When Applicable):

In circumstances where Supernova incurs administrative, depot, or operational costs, the following may also apply:

  • In-gate and out-gate depot fees
  • Restocking fees (if containers must be returned to depot or reassigned)
  • Administrative fees (for reprocessing deliveries, updating paperwork, and coordinating reattempts)
  • Supernova Containers does not profit from failed delivery fees charged by delivery partners.
  • Supernova-assessed fees cover only the actual costs required to remedy or reprocess the delivery.

7. Limitation of Liability

Supernova Containers is not liable for:

  • Delivery delays caused by weather, traffic, depot operations, or road conditions
  • Decisions made by the delivery partner regarding safety or accessibility
  • Damage occurring on-site during delivery operations performed by the independent delivery partner

Any claims related to delivery execution must be addressed directly with the delivery partner.


8. Acceptance of Terms

By scheduling delivery, the client acknowledges that they have read, understood, and agreed to these Delivery Terms & Conditions.
